General Terms and Conditions of the Workation with Christine Florentine October 17 to 26, 2024


Scope and Definitions

1.1. The following General Terms and Conditions (hereinafter referred to as "GTC") apply to all business relationships between the company Christine Fetzberger, Herrnrötherstr. 9, 63303 Dreieich, hereinafter referred to as "organizer", and our customers, hereinafter referred to in a gender-neutral manner as "participants".

1.2. The GTC apply equally to consumers within the meaning of § 13 BGB (German Civil Code) as well as to entrepreneurs within the meaning of § 14 BGB. If individual provisions only apply to entrepreneurs, this is explicitly noted at the respective point. The GTC are accessible to everyone on the internet at any time at https://www.christineflorentine.de/agb-workation-thailand.

1.3. The organizer's GTC exclusively apply. Differing, opposing, or supplementary General Terms and Conditions of the participant only become part of the contract to the extent that the organizer has expressly agreed to their validity.

Conclusion of Contract
2.1. The product on our sales page does not represent a legally binding offer, but is merely an invitation to order.

2.2. By clicking the button [Secure ticket], you place a binding order. Your purchase contract is concluded when we accept your order by an order confirmation via email immediately after receiving your order.

Prices and Payment Processing
3.1. Prices The stated price includes statutory value-added tax and other price components separately indicated.

3.2. Payment Processing Payment is made by bank transfer, as indicated on the invoice.

Right of Withdrawal and Return
4.1 The mediation of tickets by the organizer concerns distance contracts within the meaning of § 312b BGB. Regarding the mediation of tickets, there is no right of withdrawal or return for the customer, as according to § 312b (3) No. 6 BGB, the provisions on distance contracts do not apply to contracts for the provision of services in the area of scheduled leisure activities. Therefore, each ticket order is binding immediately after confirmation by the organizer and obligates acceptance and payment of the order.

Withdrawal in Case of Rescheduling or Cancellation of the Event
5.1 The organizer reserves the right to cancel the workation in case of illness or other reasons for prevention.

Participants will be informed at least 7 days before the start of the event.

In case of a rescheduling of the event date, participants can choose between attending the alternative date or refund of the ticket price.

There are no further claims of the participants against the organizer, especially no claims for damages for accommodation and travel costs.

5.2 The participant can withdraw from the purchase contract for event tickets if the event date is rescheduled or the event is completely canceled. In this case, the reversal is exclusively between the participant and the organizer.

As soon as the organizer has information about the canceled or changed event date or venue, the participant will be informed immediately after gaining knowledge of this information, as far as possible, by the organizer.

A refund of the pre-sale and system fees charged by the organizer is excluded in the event of a service disruption at the event, unless the organizer has caused this service disruption intentionally or through gross negligence. The participant therefore has no claim to a refund of the pre-sale or system fee by the organizer in particular in case of cancellation of the event or rescheduling of the date or venue.

The organizer reserves the right to withdraw from the purchase contract in case of impossibility, especially in cases of force majeure. In the event of withdrawal, the organizer will inform the participant immediately after becoming aware of all factors justifying the impossibility.

Costs already incurred for purchased flight tickets, train tickets, etc. will not be reimbursed by us.

5.3 After consultation with the organizer, the participation of a replacement person nominated by a prevented participant is possible without extra charge.

5.4 No refund of the ticket price will be made in case of a participant's non-appearance or early departure.

Cancellation Policy
6.1 It is possible to take out ticket insurance, for example with ERV Travel Insurance/Event Insurance - Cancellation without Risk, to protect against possible cancellation costs. Thus, you are protected against possible financial losses in case of cancellation or interruption of your event due to illness, accident or unemployment - also within the family. ERV (Europäische Reiseversicherung AG) is the market leader among travel insurers in Germany.

7. General Participation Conditions
Participation in the workation is voluntary. The participant takes full responsibility for themselves and their actions, both during and outside of the event. Moreover, the participant commits to treating all information related to group processes and other participants confidentially.

8. Limitation of Liability
8.1. The organizer, its legal representatives, or its vicarious agents are liable only in cases of intent or gross negligence.

8.2. The foregoing limitation of liability does not affect the organizer's liability for initial impossibility and for breaching essential contractual obligations even in the case of slight negligence, however, limited to the foreseeable, contract-typical damage. Claims for damages resulting from injury to life, body, or health, as well as under the Product Liability Act, remain unaffected by the foregoing limitation.

8.3. The organizer is not liable for lost or damaged items.

9. Right to One's Own Image
The organizer is entitled to produce and use or have used photographs, sound, and video recordings of participants without compensation in any way comprehensively in all known and future media, especially but not limited to reporting and advertising the workation and all other business activities of the organizer and its affiliated companies as well as for acquiring sponsors.

10. Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolution on the following link: https://ec.europa.eu/consumers/odr. This platform serves as a point of contact for the extrajudicial resolution of disputes arising from online sales or service contracts in which a consumer is involved. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board / universal arbitration board.

11. Final Provisions
The law of the Federal Republic of Germany applies to all legal relationships between the parties, excluding international uniform law, especially the UN Sales Law. If the participant does not have a general jurisdiction in Germany or in another EU member state, the exclusive jurisdiction for all disputes arising from this contract is the business location of the organizer.
